1. Who We Are

MerchantServices.Capital ("MSD", "we") operates the Platform at merchantservices.capital. This policy describes how we handle personal information.

2. Information We Collect

  • Account data: name, work email, phone, employer, role.
  • Merchant data you submit: business details, ownership, bank statements, processing statements, tax IDs. Submitted only with authorization.
  • Usage data: log-in events, page views, feature interactions, device and browser metadata.
  • Integration data: tokens and identifiers we receive when you connect a CRM or third-party account (e.g. HighLevel).

3. How We Use Information

  • Provide, secure, and improve the Platform.
  • Analyze merchant statements and match to lender / processor programs.
  • Send transactional, service, and (where opted in) marketing communications.
  • Comply with legal, tax, KYC/AML, and regulatory obligations.

4. Legal Bases

We process personal data under contract performance, legitimate interest (product operation and security), legal obligation, and consent where required.

5. Sharing

We share information only with: (a) sub-processors (hosting, database, email delivery, analytics, AI providers) under written data-processing terms; (b) lenders and processors you explicitly submit deals to; (c) authorities when legally required. We do not sell personal information.

6. Data Retention

We retain merchant and account data for the life of your subscription plus a reasonable period thereafter to satisfy legal, tax, and audit requirements. You may request earlier deletion where no retention obligation applies.

7. Security

We use TLS in transit, encryption at rest, role-based access, row-level security in our database, audit logs, and least-privilege service credentials. No system is perfectly secure; report suspected incidents to support@merchantservices.capital.

8. Your Rights

Depending on your jurisdiction you may have rights to access, correct, delete, export, or restrict processing of your personal data, and to withdraw consent. To exercise these rights, email support@merchantservices.capital.

9. Cookies

We use strictly necessary cookies for authentication and session management, and optional analytics cookies to improve the product. You can control cookies through your browser.

10. International Transfers

Our infrastructure is US-based. If you access the Platform from outside the US, you consent to the transfer and processing of your information in the United States.

11. Children

The Platform is not directed to children under 16 and we do not knowingly collect their data.

12. Changes

We may update this policy; material changes will be posted here with a new "Last updated" date.
